This Privacy Policy describes how MilanoMarktPlace collects, uses, stores and protects the personal data of users who visit milanomarktplace.com, use the related services or make a purchase.

2. Personal data we may process
Depending on how you use the Site, MilanoMarktPlace may process different categories of personal data.
Identification and contact data
This may include first name, last name, email address, telephone number, billing address, shipping address and other information necessary to identify the Customer and manage the relationship with MilanoMarktPlace.
Order data
This may include products purchased, amounts, delivery information, order status, returns, refunds, support requests and other information connected with the management of the sales contract.
Account data
If the Site allows the creation of a customer account, the data necessary for registration, authentication and management of the personal area may be processed.
Payment data
Transactions are managed through specialised payment providers. MilanoMarktPlace does not directly store the full credit or debit card details used during checkout.
MilanoMarktPlace may nevertheless receive information relating to the transaction, such as the payment method used, payment status, amount, any refunds and identifiers required to manage the order.
Data provided to customer service
When you contact customer service, we may process the data contained in your request, such as your name, email address, order number, information relating to the product and any documents, photographs or other information you choose to send.
Technical and browsing data
During browsing, technical information may be collected, such as IP address, device type, browser, operating system, technical identifiers, pages visited, browsing events and other information necessary for the operation and security of the Site and, where permitted, for its analysis and improvement.

3. Purposes and legal bases of processing
Managing purchases and orders
Personal data is processed to enable product purchases, manage payment, prepare the order, arrange shipping, provide tracking, manage any returns and refunds and perform the contract concluded with the Customer.
Legal basis: performance of a contract or pre-contractual measures requested by the data subject.
Providing the data necessary for the order is required in order to conclude and perform the purchase. Without this information, it will not be possible to complete the order.
Registration and account management
Where this functionality is available, data is processed to create and manage the personal account and allow the user to use the related functions.
Legal basis: performance of a contract or pre-contractual measures requested by the data subject.
Creating an account is optional where the Site allows purchases without registration.
Customer support and information requests
Data is processed to respond to requests sent by email, contact forms, Live Chat or other support channels made available on the Site.
Where the request concerns a purchase or a stage preceding its conclusion, the legal basis is the performance of the contract or pre-contractual measures requested by the data subject.
For general requests, processing may be based on the Data Controller’s legitimate interest in managing communications received and providing assistance to users.
Order-related communications

These are service communications and are not promotional communications where they are necessary to manage the contractual relationship.

Management and defence of rights
Data may be retained and used where necessary to establish, exercise or defend a right of the Data Controller or the data subject, including in out-of-court or judicial proceedings.

Where the user gives specific consent, MilanoMarktPlace may use the email address and other data provided to send newsletters, promotional communications, information about products, new availability, initiatives and commercial offers.

Consent is optional and can be withdrawn at any time by using the unsubscribe link in the communications or by writing to support@milanomarktplace.com.
Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.
5. Communications relating to similar products or services – Soft Spam
Within the limits laid down by Article 130(4) of the Italian Privacy Code, MilanoMarktPlace may use the email address provided by the Customer in connection with a previous purchase to send communications relating to its own products or services similar to those sold, without requesting further prior consent.
This possibility applies only where the conditions laid down by law are met and where the Customer, after being adequately informed, has not refused such use initially or in subsequent communications.
The Customer may object to these communications free of charge and at any time by using the link contained in the emails received or by writing to support@milanomarktplace.com.
Basis for processing: Article 130(4) of Italian Legislative Decree 196/2003, within the limits and under the conditions provided by applicable law.
6. Analytics, advertising and profiling
Subject to consent where required by applicable law, the Site may use analytics and advertising tools and tracking technologies to understand how users interact with the Site, measure campaign performance, improve services and display more relevant advertising communications.
These activities may involve the processing of information relating to browsing, interactions with the Site, products viewed and, where applicable, previous interactions or purchases.

8. Shopify platform
MilanoMarktPlace uses Shopify as the technology platform for managing the Site and its main e-commerce functions.
Shopify may process personal data to provide services such as hosting, security, technology infrastructure, store management, checkout, order processing and other functions necessary for the Site’s operation.
Where Shopify processes customer data on behalf of MilanoMarktPlace and according to its instructions, Shopify acts as a data processor under the applicable agreements.
For certain services and functions, Shopify may instead process certain personal data as an independent data controller, according to its own documentation and applicable terms.
Where MilanoMarktPlace uses advanced Shopify functions involving personalisation, analytics or advertising activities, certain information relating to interaction with the store may be processed by Shopify for those services in accordance with the legal bases and user preferences required by applicable law.
9. Recipients of personal data
For the purposes set out in this Privacy Policy, personal data may be disclosed, only to the extent necessary, to parties belonging to the following categories:
- e-commerce platform, hosting and technology-infrastructure providers;
- IT, security, maintenance and technical-support providers;
- payment providers, banks and payment networks;
- couriers, freight forwarders, logistics operators and parties involved in order delivery;
- customer-care and communications-management providers;

Parties that process personal data on behalf of MilanoMarktPlace are appointed as processors where required by Article 28 GDPR.
Some recipients may instead process data as independent controllers where they independently determine the purposes and means of the relevant processing.
MilanoMarktPlace does not directly sell its customers’ personal data to third parties in exchange for money.
10. Payment providers
When a payment method is selected, the data necessary to execute the transaction may be disclosed to the relevant provider, bank or payment network.
Those parties may process the information received according to their role, their own terms and their respective privacy notices.
MilanoMarktPlace receives the information necessary to know the outcome of the transaction, manage the order, process any refunds and comply with administrative and accounting obligations.
11. Couriers and freight forwarders
To enable delivery of orders, certain personal data is disclosed to the appointed couriers and logistics operators.
This may include, for example, the recipient’s first and last name, delivery address, telephone number, email address and other information necessary for the correct management of the shipment.
12. Third-party content and services

- Standard Contractual Clauses approved by the European Commission;

Where necessary, additional measures appropriate to the nature of the transfer and the identified risks are also adopted.
15. Retention period
Personal data is retained for no longer than necessary for the purposes for which it was collected, without prejudice to any longer period required by law or necessary for the establishment, exercise or defence of a right.
Retention periods are determined taking into account the purpose of processing, the nature of the data, applicable regulatory obligations and any need to protect the rights of the parties.
Purchase data
Data and documentation relating to orders and the contractual relationship may be retained for up to 10 years, where necessary to comply with applicable civil, accounting and tax obligations and to allow the parties’ rights to be protected.
Tax and accounting documentation
Invoices and accounting documentation are retained for the period required by applicable law, generally for at least 10 years.
Account data
Account data is retained for as long as the account remains active and subsequently for any period necessary to comply with legal obligations or protect the parties’ rights.
Deleting the account does not necessarily result in the deletion of information that MilanoMarktPlace is required to retain for tax, accounting, contractual or legal obligations.
Customer-service data
Communications with customer service are retained for the time necessary to manage the request and subsequently, where necessary, to document the assistance provided, manage any disputes or protect the parties’ rights.
Data processed for marketing based on consent
Data used for marketing purposes based on consent is processed until consent is withdrawn or for as long as the purpose of processing remains relevant and proportionate to the relationship with the data subject.
MilanoMarktPlace periodically verifies whether it is necessary to continue retaining such data and deletes or anonymises it when it is no longer necessary for the purpose pursued.
Data used for Soft Spam
The email address used within the limits of Article 130(4) of the Italian Privacy Code may be processed for this purpose until the Customer objects or until the legal conditions for sending communications relating to similar products or services no longer apply.
Consents and objections
Information necessary to document consent, withdrawal, an unsubscribe request or an objection may be retained for the period necessary to demonstrate compliance with the data subject’s request and applicable obligations.
Cookies and identifiers
The duration of cookies and other tracking tools is indicated in the Cookie Policy and in the preference-management tools available on the Site.
16. Data security
MilanoMarktPlace adopts technical and organisational measures appropriate to the risk to protect personal data against unauthorised access, loss, alteration, destruction, disclosure or unlawful use.
Access to data is limited, as far as possible, to persons who need the information to carry out activities connected with the purposes set out in this Privacy Policy.
No IT system can guarantee absolute security. MilanoMarktPlace therefore keeps its protection measures appropriate to the services used, the risks identified and technological developments.
17. Children’s data
The Site and MilanoMarktPlace services are not specifically directed at children, and MilanoMarktPlace does not intend knowingly to collect personal data relating to minors without the conditions required by applicable law being met.

18. Automated decision-making
MilanoMarktPlace does not use data collected through the Site to make, directly and independently, decisions based solely on automated processing that produce legal effects concerning the data subject or similarly significantly affect them, unless otherwise indicated and permitted by applicable law.
Any personalisation or profiling for marketing purposes does not in itself produce such effects and is carried out in accordance with the legal bases and user preferences described in this notice.
Payment providers, anti-fraud systems or other third parties may adopt their own automated procedures according to their respective notices and responsibilities.
19. Rights of the data subject
Where provided by law, the data subject may exercise the rights recognised by Articles 15 et seq. GDPR.
In particular, the data subject may request:

Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.
