Terms and Conditions of Sale

Before placing an order, the Customer is invited to carefully read these Terms, the information available on the product page and the other notices referred to during the purchasing process.

2. Scope of application
These Terms apply to sales of products made by the Seller through the Site.
For the purposes of these Terms, a Consumer is a natural person who purchases for purposes unrelated to their business, commercial, craft or professional activity.
A Professional is a natural or legal person who purchases in the course of their business, commercial, craft or professional activity, including through an intermediary.
The protections specifically provided by law for Consumers apply only when the Customer qualifies as a Consumer.
The Terms applicable to each purchase are those published on the Site and in force when the order is submitted.
MilanoMarktPlace may amend these Terms in the future. Any amendments do not affect contracts already concluded before they enter into force.
3. Product information
The essential characteristics of each product are stated on the relevant product page.
Before purchasing, the Customer is invited to carefully check the description, material, dimensions, colour, variant, included accessories and any other information shown on the product page.
Photographs are representative. Colours, textures and finishes may appear slightly different depending on the screen, device used and lighting conditions.
Such display differences do not affect the rights granted to Consumers where a product is actually non-compliant with the contract.

4. Purchase procedure and conclusion of the contract
Orders are placed through the purchasing procedure available on the Site.
To complete an order, the Customer must select the desired products, enter the required information, choose from the available payment and delivery methods and check the order summary before final confirmation.
Before submitting the order, the Customer can identify and correct any data-entry errors.
By submitting the order, the Customer makes an offer to purchase the products indicated in the summary.
Technical receipt of the order may be communicated automatically by the Site. The sales contract is concluded when MilanoMarktPlace expressly confirms acceptance of the order by means of a communication sent to the email address provided by the Customer.
The confirmation states, or allows the Customer to retrieve, the main information concerning the purchase, including the products ordered, amounts, delivery address and payment method used.
Email, Live Chat and other support channels may be used to obtain information and assistance, but do not replace the Site checkout procedure unless otherwise expressly and demonstrably agreed between the Customer and MilanoMarktPlace.
5. Data provided by the Customer
The Customer is responsible for the accuracy and completeness of the information provided during the purchase, including contact, billing and delivery details.
The Customer is invited to check this information carefully before confirming the order and to promptly report any errors.
If the Site allows the creation of a personal account, the Customer is responsible for keeping their credentials confidential and must promptly inform MilanoMarktPlace if they suspect unauthorised access or use.
6. Product availability
The availability shown on the Site reflects the information in MilanoMarktPlace systems at the time of consultation. However, particularly for items available in limited quantities, it may exceptionally happen that several customers purchase the same product within a very short period.
If an ordered product is unavailable, MilanoMarktPlace will inform the Customer without undue delay.
MilanoMarktPlace may offer an alternative product, without any obligation for the Customer. Any substitution may take place only with the Customer’s express acceptance.
If no alternative solution is agreed, any amount already paid for the unavailable product will be refunded without undue delay using, unless otherwise agreed, the same payment method used for the purchase.
7. Prices
The applicable prices are those displayed on the Site at the time of the order, except in the case of obvious and recognisable material errors.
The final order price, including any applicable additional charges, is shown to the Customer before the purchase is confirmed.
Product prices shown to Consumers include VAT where applicable.
MilanoMarktPlace may change product prices at any time. Subsequent changes do not affect orders already concluded.
If there is an obvious and recognisable material error in a published price, MilanoMarktPlace will inform the Customer before accepting the order. Where possible, the Customer may confirm the purchase at the correct price or cancel the order. In the event of cancellation, any sums already charged will be refunded without undue delay.
In all cases, the Customer’s mandatory rights under applicable law remain unaffected.
8. Shipping costs, taxes and duties
Standard shipping is free for orders delivered to Italy and countries within the European Union.
For destinations outside the EU, including the United Kingdom and Switzerland, standard shipping costs €29.99, unless different conditions or promotions are clearly indicated on the Site or during checkout.
For shipments outside the European Union, customs duties, import taxes, local taxes, administrative charges or customs-clearance costs imposed by the destination country may apply.
Unless expressly stated otherwise during checkout, these amounts are not included in the product price or shipping charges and are borne by the recipient.

9. Payment methods
The payment methods actually available are shown during checkout and may vary depending on the country, currency, order amount, device used and services supported by payment providers.
Credit and debit cards, digital wallets, PayPal, instalment-payment solutions and other local or international methods shown during checkout may be available.
The Customer always sees the methods actually available before confirming the order.
Transactions are processed through dedicated payment providers and infrastructures. MilanoMarktPlace does not directly store the complete details of payment cards used by the Customer.
The selected payment institution, bank or provider may require authentication or security checks before authorising the transaction.
The specific terms of any instalment-payment service are established by the relevant provider and shown to the Customer before payment is completed.

10. Discount codes and promotions
MilanoMarktPlace may make discount codes, vouchers, coupons or other promotions available.
Each promotion is subject to the conditions stated when it is published or communicated, including any limitations regarding duration, products, minimum spend, number of uses or excluded categories.
Whether multiple codes or promotions can be combined depends on the conditions of the individual initiative and is verified by the system during checkout.
Unless otherwise required by law or by the promotion terms, promotional codes cannot be converted into cash.
11. Gift Cards
MilanoMarktPlace Gift Cards may be purchased on the Site.
After purchase, the Gift Card is provided digitally by email and contains a code that can be used for purchases on the Site under the conditions stated on the relevant product page.
The Gift Card is valid for the period indicated at the time of purchase. MilanoMarktPlace Gift Cards are currently valid for 12 months from the date of issue, unless otherwise expressly stated on the relevant page.
If the order value exceeds the available Gift Card balance, the difference can be paid using one of the other payment methods available at checkout.
If the order value is lower than the available balance, the remaining credit remains usable until its expiry date.
A Gift Card cannot be used to purchase another Gift Card unless expressly stated otherwise on the Site.
The Customer is responsible for safeguarding the code received and must promptly contact MilanoMarktPlace if they believe it may have been used without authorisation.
The terms applicable to Gift Cards do not limit any mandatory rights granted to Consumers by applicable law, including the right of withdrawal where applicable.
12. Order preparation and shipping
Each order is subject to the verification, preparation and quality-control activities established by MilanoMarktPlace.
Preparation generally takes 2 to 10 business days and takes place before the parcel is handed over to the courier.
After shipment, the Customer receives a communication containing tracking information and, where available, an estimated delivery date.
Delivery times provided by the courier after shipment are indicative and may be affected by destination, public holidays, customs checks, exceptional events or other circumstances not directly controlled by MilanoMarktPlace.
Delivery will take place within the period communicated to the Customer or, in the absence of a different period expressly agreed, within the period required by applicable law.
13. Delivery and transfer of risk
Delivery is deemed completed when the Customer, or a third party designated by the Customer other than the carrier, physically acquires possession of the product.
The risk of loss of or damage to the product for reasons not attributable to MilanoMarktPlace passes to the Consumer only when the Consumer, or the third party designated by them, physically takes possession of the product.
If the Consumer independently chooses a carrier not offered by MilanoMarktPlace, the rules provided by applicable law apply.
At the time of delivery, the Customer is invited to check the external integrity of the parcel and the number of packages.
If there is obvious damage, tampering or other anomalies, it is advisable, where possible, to accept delivery subject to reservation and promptly contact MilanoMarktPlace, attaching photographs of the parcel and product.
Failure to make an immediate report to the courier does not result in the loss of mandatory rights granted to the Consumer under the legal guarantee of conformity.
14. Failed delivery or incorrect shipping information
The Customer must provide a complete and correct delivery address and cooperate with the courier where necessary to enable delivery.
If a failed delivery, storage at a depot, return to sender or new shipment results from an incorrect or incomplete address, failure to collect or another cause attributable to the Customer, only the actual and documentable costs incurred by MilanoMarktPlace may be charged, in compliance with applicable law.
15. Consumer’s right of withdrawal
A Consumer purchasing at a distance has the right to withdraw from the contract without giving any reason within 14 calendar days.
For an order concerning a single product, the period starts on the day on which the Consumer, or a third party designated by them other than the carrier, takes physical possession of the product.
For several products ordered in a single order and delivered separately, the period starts on the day the last product is delivered.
The right of withdrawal provided for Consumers does not apply to purchases made in the course of a business, commercial, craft or professional activity unless otherwise expressly agreed.
16. How to exercise the right of withdrawal
To exercise the right of withdrawal within the applicable period, the Consumer may:
- use the online function available on the Withdrawal Form page;
- or send an unequivocal statement of their decision to support@milanomarktplace.com.
The communication must allow the Consumer, the contract or order from which they wish to withdraw and an electronic contact address to which confirmation can be sent to be identified.
When withdrawal is exercised through the online function available on the Site, MilanoMarktPlace sends confirmation of receipt without delay on a durable medium, for example by email.
The right is exercised in time when the communication is sent before the withdrawal period expires.
17. Returning products after withdrawal
After communicating withdrawal, the Consumer must return the product without undue delay and, in any event, within 14 calendar days from the date on which they communicated their decision.
The deadline is met when the product is handed to the carrier before the 14-day period expires.
Customer service informs the Consumer of the return address and any operating instructions.
Where withdrawal is due simply to a change of mind, the direct cost of returning the product is borne by the Consumer.
The Consumer may choose the courier provided that an appropriate and trackable shipping method is used. Given the value of certain products, it is advisable to insure the shipment for an appropriate amount.
Return costs are instead borne by MilanoMarktPlace where required by law or where the return results from a cause attributable to MilanoMarktPlace, for example an incorrect, damaged, defective or non-conforming product.
In such cases, the Customer is invited to contact customer service before independently arranging shipment so that the necessary instructions can be provided.
18. Condition of the returned product
During the withdrawal period, the Consumer may examine and try the product to the extent necessary to establish its nature, characteristics, operation and fit, similarly to what could reasonably be done in a physical shop.
The product must be handled with care and returned complete with accessories, documentation, tags, labels and any items received with the order, insofar as they are still available and relevant to the product.
Original packaging must be returned where it is an integral part of the product or affects its commercial value.
The Consumer is liable only for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the product.
If a reduction in value is established, MilanoMarktPlace may make a proportionate deduction from the refund and will inform the Consumer of the reasons.
No fixed or automatic penalties are applied for exercising the right of withdrawal.
19. Refund in the event of withdrawal
Where withdrawal is validly exercised, MilanoMarktPlace will refund payments received in relation to the products concerned and, where originally paid by the Consumer, the cost of the least expensive standard delivery method offered by the Site.
Any additional costs resulting from the voluntary choice of a more expensive delivery method than the standard delivery offered are not refunded.
The refund is issued without undue delay and in any event within 14 days from the day on which MilanoMarktPlace was informed of the decision to withdraw.
MilanoMarktPlace may withhold the refund until it receives the products or until the Consumer provides evidence that they have sent them back, whichever occurs first.
The refund is made using the same payment method used for the purchase, unless otherwise expressly agreed with the Consumer and provided that the Consumer does not incur costs as a result.
Store credit instead of a monetary refund is issued only when the Customer requests or expressly accepts it.
20. Exceptions to the right of withdrawal
The right of withdrawal is excluded only in the cases provided by applicable law.
In particular, where relevant to the MilanoMarktPlace catalogue, the right may be excluded for goods made to measure or clearly personalised according to individual specifications requested by the Consumer.
Other exceptions expressly provided by applicable law may also apply where relevant to the nature of the purchased product. In such cases, any exclusion of the right of withdrawal is clearly communicated to the Consumer before the order is concluded.
The mere fact that a product is sourced or ordered by MilanoMarktPlace from a supplier after the Customer’s order does not, in itself, exclude the right of withdrawal.

21. Exchanges
The right of withdrawal does not automatically entail the right to replace the product with a different item.
If the Customer wishes to exchange a size, colour, model or product, they may contact customer service.
Whether an exchange can be made depends on the availability of the requested product and the conditions agreed with MilanoMarktPlace.
The Consumer’s rights in the event of lack of conformity always remain unaffected.
22. Legal guarantee of conformity
The legal guarantee of conformity provided by the Italian Consumer Code applies to Consumers.
MilanoMarktPlace is liable to the Consumer for lack of conformity existing at the time of delivery and becoming apparent within the period provided by applicable law.
For new goods, the legal guarantee lasts 2 years from delivery.
For any used goods, where applicable, MilanoMarktPlace and the Consumer may agree on a shorter period of liability than for new goods, provided that it is not less than 1 year from delivery and the condition is expressly agreed in compliance with applicable law.
Unless proved otherwise and within the limits established by law, a lack of conformity that becomes apparent within one year from delivery is presumed to have existed at the time of delivery, unless that presumption is incompatible with the nature of the goods or the nature of the defect.
Where a lack of conformity exists, the Consumer is entitled to the remedies provided by law. In the first instance, when the relevant conditions are met, the Consumer may request that conformity be restored by repair or replacement. In the cases provided by law, the Consumer may also be entitled to a proportionate price reduction or termination of the contract.
Remedies under the legal guarantee are provided without cost to the Consumer in the cases and according to the procedures laid down by applicable law.
The legal guarantee does not cover damage resulting from improper use, normal wear and tear, lack of care or use inconsistent with the product’s characteristics, without prejudice to the fact that these circumstances must be assessed case by case and do not limit the Consumer’s mandatory rights.
23. Purchases by Professionals
The provisions of the Italian Consumer Code reserved for Consumers do not apply to purchases made by persons acting for business, commercial, craft or professional purposes.
For such purchases, among other provisions, the rules of the Italian Civil Code on warranties for defects apply, within the limits and under the conditions established by applicable law.
24. Any commercial manufacturer warranties
Some products may benefit from a commercial warranty offered by the manufacturer or a third party.
Any commercial warranty is additional to the legal guarantee and does not replace or limit the rights granted to the Consumer against MilanoMarktPlace.
The existence and terms of a commercial warranty are indicated on the product page or in the documentation supplied, where applicable.
25. Complaints and support

26. Reviews and testimonials
The Site may display customer reviews or testimonials and may integrate or reproduce content from external review platforms, including Trustpilot.
Where a review comes from a third-party platform, the collection, verification, moderation and publication methods are also governed by the rules of that platform.
MilanoMarktPlace does not present a review as coming from a verified purchase unless this has actually been established or is indicated by the system used to collect the review.
Any reviews, testimonials or content published as part of collaborations, incentives or other promotional initiatives are presented in compliance with applicable transparency obligations.
27. Intellectual property
The Site’s original content, including texts, graphic elements, directly produced photographs, layouts and other materials, is protected by applicable intellectual-property and copyright law.
Third-party trademarks, logos, product names and content remain the property of their respective owners.
The use of third-party trademarks and names on the Site is intended to identify and describe the products sold and does not imply, unless expressly stated, any affiliation, sponsorship or endorsement by the respective owners.

28. Operation of the Site
MilanoMarktPlace takes reasonable measures to ensure the availability and proper functioning of the Site.
Temporary interruptions or limitations may nevertheless occur due to maintenance, updates, technical problems, third-party services or circumstances not directly controlled by MilanoMarktPlace.
Nothing in these Terms excludes or limits MilanoMarktPlace’s liability where such exclusion or limitation is not permitted by law.
29. Protection of personal data
Personal data collected through the Site is processed as described in the Privacy Policy.

30. Applicable law
Contracts concluded through the Site are governed by Italian law, without prejudice to the application of mandatory provisions protecting Consumers that may be provided by the law of the country in which the Consumer has their habitual residence, where applicable.
31. Competent court
For disputes involving a Customer who qualifies as a Consumer, jurisdiction lies with the court determined under the mandatory provisions applicable to Consumer protection and, in particular, the court of the Consumer’s place of residence or domicile where provided by law.
For disputes involving Customers purchasing as Professionals, unless otherwise required by mandatory law, the court of the place where MilanoMarktPlace has its registered office has jurisdiction.
32. Alternative dispute resolution
In the event of a dispute, the Consumer is invited first to contact MilanoMarktPlace in an attempt to reach a direct solution.
If the dispute is not resolved, the Consumer may apply to the competent consumer alternative dispute resolution (ADR) bodies in the cases and according to the procedures provided by applicable law.
In all cases, the Consumer’s right to bring proceedings before the competent judicial authority remains unaffected.
33. Severability
If a provision of these Terms is declared null, invalid or ineffective, this does not automatically render the remaining provisions invalid; they continue to have effect to the extent permitted by law.
34. Precedence of mandatory rights
These Terms must be interpreted and applied in accordance with applicable law.
No provision of these Terms may be interpreted as a waiver or limitation of rights that the law mandatorily grants to Consumers.
